Art. 1 Entry into force
When entering the boat, when using sports equipment and when carrying out activities in connection with the offer of WAKESURF.WORLD, the following general terms and conditions are accepted. WAKESURF.WORLD informs verbally that these are recognized when entering the boat.
Article 2 Health
Every customer assures that he is healthy and has the necessary physical prerequisites, in particular the ability to swim. The customer assures that he is free from heart and circulatory problems as well as serious orthopedic problems. Personal responsibility, prudence and realistic self-assessment are required of every customer.
Art. 3 Age
The minimum age for use is 8 years when accompanied by parents and 12 years unaccompanied. In the case of underage customers, use requires the express written consent of a legal representative. The legal representative assures that the underage customer has the necessary health and physical requirements. The legal representative is fully liable for damage to persons, the system and the equipment caused by the misconduct of the underage customer.
Art. 4 Safety equipment
For safety reasons, all sports equipment may only be used with the appropriate safety equipment. Exceptions must be confirmed in writing. The statutory safety devices are available on the boat and will be instructed by the boatman in the event of an emergency.

The instructions of the boatman must always be followed.
Art. 6 Smoking ban
Smoking is strictly prohibited on the boat and jetty.
Art. 7 Liability
The implementation of water sports activities and the use of sports equipment is at your own risk and responsibility. Activities in this area inevitably involve certain risks. With his booking, the customer declares that he is aware of the risks and dangers associated with water sports. Explicit information and clarification by the operator is not required for this.
Art. 8 Personal injury and damage to property
The customer is liable for personal injury and damage to property. Any liability is excluded for valuables and equipment that are deposited, kept or stored with the operator. The participant is responsible for his own insurance cover. The participant is liable for damage which he causes negligently or intentionally. The participants are fully responsible for any discolouration of the upholstery caused by hair dye. Hair dyes can cause discoloration on upholstery that cannot be cleaned.
The equipment will be provided to the participants free of charge. The participant is obliged to handle the equipment carefully. The participant is liable for damage to the equipment caused intentionally or through negligent care. The customer must also pay for damage to the boat caused by negligence.
Art. 9 Offer
Session packages cannot be transferred to other people. The booking of a session is always billed at 100%, even if the time has not been fully used. The purchased minute packages are only valid in the same calendar year. WAKESURF.WORLD assumes no liability for the published opening hours. The written appointment confirmations are decisive.
Article 10 Prices
All prices are in CHF. Sessions and booked services are due immediately after receipt of the service. WAKESURF.WORLD reserves the right to charge part or all of the costs in advance for certain offers.
Art. 11 Withdrawal
Individual bookings can be canceled free of charge by email up to 24 hours in advance. Bookings for groups over 6 people or packages over 3 hours are free of charge up to 48 hours before the appointment. For later cancellations, 50% of the booking will be charged. The operator reserves the right to cancel a booking for weather-related reasons or if the boat fails at short notice without being entitled to compensation or compensation.
Art. 12 Data protection
Photos taken during a session or an event by one of WAKESURF.WORLD may be used both on the WAKESURF.WORLD homepage and on its social media portals such as Facebook and Instagram . Consent can be given verbally. Further information on data protection is contained in the data protection declaration.
Art. 13 Jurisdiction
The provisions of Swiss law apply, even if the booking is made from abroad or the customer lives abroad.
Place of jurisdiction is Thun.
